End-User License Agreement and Terms of Service (EULA / ToS)

These Terms of Service (hereinafter "Terms") constitute a legally binding agreement between Muhammad Waheed Samir (doing business as NilotalK, hereinafter the "Vendor," "We," or "Us") and you, the purchaser and user of the mobile application (hereinafter the "Buyer," "Customer," or "You").

Please read these Terms carefully before purchasing, downloading, or activating the NilotalK App.

1. Acceptance of Terms and Key Definitions

1.1. Acceptance: By purchasing, activating, or using the NilotalK App, you agree to be bound by these Terms.

1.2. Key Definitions:

  • App/Software: Refers to the compiled NilotalK mobile application (APK or related formats).
  • License Key: The unique key provided upon purchase, required to activate the App.
  • Customer Database: The third-party backend services (e.g., Firebase, Cloudinary) owned, hosted, and managed entirely by the Customer.

2. License Grant and Restrictions

We grant you a non-exclusive, non-transferable license to use the App under the following conditions:

  • 2.1. Single Project Binding: The License Key grants you the right to bind and operate the App with one single Firebase Project ID. Reusing the same license for multiple, entirely different commercial projects is prohibited.
  • 2.2. No Reverse Engineering: You may not decompile, reverse engineer, disassemble, or attempt to derive the source code of the App.
  • 2.3. No Redistribution: You may not sell, resell, sublicense, or distribute the App as your own standalone product without prior written consent.

3. Bring Your Own Database (BYOD) & Data Privacy

The NilotalK App is designed as a client-side interface that connects directly to the infrastructure provided by you.

  • 3.1. Zero Data Retention by Vendor: The Vendor does not collect, store, intercept, or have any access to your end-users' personal data, chat messages, media files, or passwords. All operational data is stored directly in your connected Firebase/Cloudinary accounts.
  • 3.2. License Verification Data: The only data transmitted to the Vendor's servers is strictly for license verification purposes. This includes your License Key and your Firebase Project ID to ensure the license is not being abused across multiple distinct projects. No sensitive Firebase secrets are sent to us.
  • 3.3. Customer Compliance: Because you hold the database, you are fully responsible for complying with local and international data privacy laws (such as GDPR, CCPA) regarding the users of your App.

4. Infrastructure Costs and Responsibilities

4.1. Third-Party Costs: The App relies on third-party services (Firebase, Cloudinary, etc.). You are solely responsible for any usage limits, billing, or overage charges incurred on these third-party platforms resulting from the use of the App.

4.2. Configuration: You are responsible for properly configuring your database security rules to ensure your users' data remains secure.

5. Payment and Refund Policy

5.1. Payment Processor: All payments and financial transactions are processed securely by our partner, Payhip.

5.2. Refunds: Fees paid for the purchase of the license are subject to the Refund Policy published on our Payhip store or official website. Because the software is delivered digitally, refunds are typically only granted under specific technical circumstances within the stated refund period.

6. Termination of License

This license will terminate immediately and without notice if you violate any material term of this Agreement (e.g., attempting to reverse engineer the App or bypassing the license verification system). Upon termination, the Vendor reserves the right to revoke the License Key remotely.
